1. Owner of the website
Sirvely is a trading name, not a separate company. Behind the name is a Dutch company that owns this website and is responsible for the service, registered with the Netherlands Chamber of Commerce (KvK) under number 86964178. We publish these details to meet the duty of information that the rules on information society services place on anyone offering a service online: article 3:15d of the Dutch Civil Code, which governs the company as it is established in the Netherlands, and, for the service we provide in Spain, article 10 of Spanish Law 34/2002 on information society services and electronic commerce.

When this page says Sirvely, we or the owner, it always means that company. When it says you or the customer, it means the restaurant, bar or café that takes out the service.

It is the same email address for everything: commercial matters, technical incidents and the exercise of your data protection rights. That way you never have to work out whom to write to.
3. Purpose of this website
https://www.sirvely.com is an information site. Here we explain what Sirvely is, how it works and what it costs, but nothing is ordered from here, no table is managed here and no account is accessed here. The service itself runs at a different address,https://app.sirvely.com, which is where the restaurant signs in to its account and where the menu opens when someone scans the QR code on the table.
The service is a QR-code ordering system for the hospitality trade. The guest scans the code on their table, sees the menu and orders from their own phone, without downloading any app and without registering, and at the end asks for the bill from the same place. The restaurant takes the payment, with its own card terminal or in cash. At no point do we receive, hold or transfer the guest's money, so Sirvely is neither a payment institution nor a payment service provider. The only thing we charge is our own subscription to the restaurant, on the terms set out in the terms and conditions.
Sirvely is aimed exclusively at businesses: restaurants, bars and cafés operating in Spain or in the Netherlands. It is not aimed at consumers. The guest uses the menu and places their order, but does not enter into any contract with us and is not our customer; they are the restaurant's customer.
4. Conditions of use
Browsing this site is free and does not require you to register or to give us any details. By using it you undertake to do so lawfully and in good faith, not to damage it, not to try to reach parts that are not public and not to use automated means that alter or overload it.
What is said here is general information and does not replace the contract. If something on this website and something in the terms and conditions seem to say different things, the terms and conditions and the contract you have signed prevail. We may change, update or remove the contents of this site at any time and without prior notice.
5. Intellectual and industrial property
The Sirvely name, the logo, the design of these pages, the texts, the icons, the images and the software behind the service belong to the owner or to those who have granted us a licence over them. They may not be reproduced, distributed, altered or communicated to the public without our written permission, beyond normal browsing and printing a page for your own use.
Everything the restaurant uploads remains the restaurant's. Your trading name, your logo, the colours you give your menu, the photographs, the descriptions of the items on your menu and the prices are yours and do not become ours because they are published on Sirvely. We use them solely to provide the service, that is, to show them on the menu the guest sees and in the restaurant's panel. In return, it is you who are responsible for holding the rights to what you upload.
6. Links to third parties
From this site there are only three links that lead outside it. The contact button opens your email program with our address already filled in. The sign-in button leads to https://app.sirvely.com, which is where the service lives. And in the privacy policy we link to the pages of the two data protection authorities, so that you can reach them without searching for them.
Access to the service is ours and is governed by this legal notice and by the terms and conditions.
7. Liability and availability
We take care that what you read on this site is correct and up to date, but it is general information and may contain errors or become outdated. The prices and conditions that bind you are those in the terms and conditions and in your contract, not those on an information page.
We take reasonable steps to keep this site available, although we do not guarantee that it will be available without interruption. It may be temporarily out of service for maintenance, because of a network failure or for reasons beyond our control, and we are not liable for any loss arising from this information website being temporarily unavailable.
The service at https://app.sirvely.com is another matter. That is what you contract, and its availability, support, maintenance and the limits of our liability are governed by the terms and conditions. What this section says about the information website does not reduce or replace what is agreed there.
8. Data protection
This website collects nothing from its visitors. It sets no cookies, runs no statistics or tracking pixels, embeds no videos or maps, and the fonts are served from our own server, so your visit generates no request to third parties. It stores only three things in the browser, and none of them leaves your device on its own: that you have read the information notice in the footer, the language you chose and, if you came through a partner's link, their code. In that last case the website tells our API once that there has been a visit through that link, with no data of yours other than the code itself. There is no consent banner because there is nothing to consent to.
The service does process data, mostly about the restaurant and its staff and to a much lesser extent about the guest. Which data they are, what we use them for, who helps us process them and how long we keep them is explained in the privacy policy. The session cookies needed to keep someone signed in to the panel are explained in the cookie policy. To exercise your rights you can email us at info@sirvely.com.
9. Applicable law
This legal notice and the use of this website are governed by Dutch law, the law of the country where the owner has its registered office. Any dispute arising from this legal notice or from the use of this website will be heard by the Dutch courts of the place where the owner has its registered office.
None of the above takes away anything the law guarantees you on a mandatory basis. The mandatory rules of the country where your establishment is located, which in practice will be Spain or the Netherlands, continue to apply, and this clause does not seek to exclude or limit them. If a court finds any part of this legal notice void, the rest remains valid.
